Thompson v. Pennacchia et al
The plaintiff was a passenger in a car being driven by a friend when the defendant officers pulled over the car. After stopping the car, the driver exited the vehicle and attempted to leave the location on foot, but was quickly apprehended by the officers. The officers drew their guns and ordered everyone else out of the vehicle including the plaintiff. The plaintiff asked why another individual from the car was being arrested and immediately the defendant officers told her to shut up, tightly handcuffed her, and took the plaintiff to a nearby precinct. She was charged with Obstruction of Governmental Administration in the Second Degree. The charges were ultimately dismissed.
