Summary
Plaintiff had just left a New Year's Eve party when his friend asked him to watch his car for a few minutes, as it was parked illegally. Plaintiff stood in front of the car and did not operate the vehicle. He was then approached by multiple police officers. Plaintiff informed the officers that the car was not his vehicle and that the owner was upstairs. The officers requested his identification and the plaintiff gave his driver's license, which was expired. The officers then searched the plaintiff and pat him down, and allegedly, officers found a bag of marijuana on his person. The plaintiff was then arrested and charged with aggravated unlicensed operation of a motor vehicle in the 2nd and 3rd deg, unlicensed driving, and unlawful possession of marijuana.
