Defendant Officers approached Plaintiff while she was with a friend on the stoop of an apartment building and questioned if empty open containers near them were theirs. Plaintiff said no because she hadn't been drinking. Then the officers entered the apartment building and went up to the apartment where Plaintiff's friends were having a party. Plaintiff followed and advised her friends they did not have to allow the officers in. Officer Pennacchia then slammed Plaintiff, handcuffed her, and took her to the 28th Precinct. Officers found a fake ID in her purse and charged her with charged her with 170.25 criminal possession of a forged instrument, possession of alcohol by a minor (for the empty bottles on the stoop), and disorderly conduct. All charges were later dismissed.
