Barnes v. City of New York et al.
Defendant Officers approached plaintiff on the street corner. Defendant officers were going to issue a ticket to a double parked car when plaintiff asked for them to wait until he could get the driver out to move the vehicle. The Defendant officers then arrested the plaintiff. PO Bergen handcuffed plaintiff, and the officers drove him in a patrol car to the 45th precinct. He was charged by the officers with driving while intoxicated. The plaintiff was released later that day and acquitted of all charges.
