The plaintiff was the passenger in his friend' s vehicle at the time of the incident. The plaintiff and his friends had not committed any traffic infractions when they were pulled over by an unmarked police car and the defendant officers, in plain clothes, approached. The defendant officers had each of the plaintiff's friends get out of the vehicle, and when the plaintiff was asked to do so he asked why and was answered with the defendant officers chocking the him, beating him, handcuffing him, and finally transporting him to a nearby precinct. The plaintiff was charged with resisting arrest and assault. The charges were later dismissed.
