Garcia v. Gridley et al
The plaintiff was on the sidewalk at the intersection of Liberty Ave and 122nd St when the defendant officers pulled up in their vehicle, approached the plaintiff, and asked him where he had been the previous day. The plaintiff stated he was home the previous day, but the officers chose to then handcuff the plaintiff and take him to the 106th Precinct where he participated in a line up. The plaintiff was not identified in the line up as the man the officers were looking for, but despite this he was charged with robbery in the first degree and menacing in the second degree. For a month the plaintiff remained in a correctional facility waiting for trial sine he could not afford bail. The charges were dropped.
